Terms of Service

These Terms of Service (“Terms”) form a binding agreement between you and [Company Name](“newsite,” “we,” “us,” or “our”) and govern your access to and use of newsite’s AI-powered website creation and hosting service (the “Service”). By using the Service or claiming the offer, you agree to these Terms.

1. Changes and Modifications

We may modify these Terms or our pricing from time to time. For price changes affecting your subscription, we will give you at least 30 days’ notice. Your continued use of the Service after a change takes effect constitutes acceptance of the updated Terms.

2. The Service

newsite uses AI together with a human design team to create a custom website for you based on the information you provide, and then hosts and maintains that website on an ongoing subscription. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service. We may update, change, or discontinue features of the Service at any time.

3. Eligibility

You must be at least 16 years old (or the age of majority in your jurisdiction) and able to form a binding contract to use the Service. If you use the Service on behalf of a business, you represent that you are authorized to bind that business to these Terms.

4. Acceptable Use

You agree not to:

  • resell, sublicense, or commercially exploit the Service except as expressly permitted;
  • copy, reverse engineer, or attempt to extract the source code of the Service;
  • use the Service to create or host unlawful, infringing, deceptive, or harmful content;
  • circumvent security, scrape, overload, or interfere with the Service or its servers;
  • upload malware or use the Service to violate the rights of others.

5. Subscriptions, Trial, and Billing

The Service is offered through a trial-and-subscription model. By claiming the offer, you authorize us and our payment processor to charge your payment method as follows:

  • $1 trial activation — a one-time, non-recurring charge billed immediately when you claim the offer, which activates your 7-day free trial.
  • 7-day free trial — during this period your website is built and you can evaluate the Service. You will not be charged the hosting fee during the trial.
  • $49.99/month hosting — unless you cancel before the trial ends, your subscription automatically begins at the end of the 7-day trial and renews monthly at $49.99 (excluding applicable taxes) until cancelled.
  • $37/month VIP Support (optional) — if you add VIP Support, it is a separate, auto-renewing subscription that shares the same trial period and begins billing at $37/month at the end of the trial unless cancelled.

All fees are charged in advance for each billing period and, except as set out in our Refund Policy, are non-refundable. Renewal charges are applied automatically to your payment method on file. You are responsible for keeping your payment information current.

Cancellation. You may cancel either subscription at any time by emailing support@newsite.now. Cancellation stops future renewals; your subscription (and access to hosting) remains active through the end of the current billing period. We do not yet offer an in-app cancellation flow, so please use email. Cancelling one subscription (for example, VIP Support) does not cancel the other.

6. Intellectual Property

The content you provide and the website we build for you (your text, images, and branding) remain yours. You grant us a license to use that content solely to provide, host, and improve the Service. The newsite platform, software, design systems, and templates remain the property of [Company Name] and its licensors, and nothing in these Terms transfers ownership of them to you.

7. Third-Party Links and Services

The Service relies on third-party providers (including our subprocessors) and may link to or integrate third-party websites and services. We are not responsible for the content, policies, or practices of any third party, and your use of those services is governed by their terms.

8. Termination

You may stop using the Service at any time by cancelling as described in Section 5. We may suspend or terminate your access to the Service if you breach these Terms or use the Service in a way that creates risk or legal exposure for us or others. Sections relating to intellectual property, disclaimers, limitation of liability, and indemnification survive termination.

9. Disclaimer of Warranties

The Service is provided “as is” and “as available,” without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that any website built through it will achieve any particular result.

10. Limitation of Liability

To the maximum extent permitted by law, [Company Name] will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill arising from your use of the Service. Our total liability for any claim arising out of or relating to the Service will not exceed the amounts you paid us in the 12 months preceding the claim.

11. Indemnification

You agree to indemnify and hold harmless [Company Name] and its officers, employees, and agents from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising out of your content, your use of the Service, or your breach of these Terms.

12. Governing Law and Disputes

These Terms are governed by the laws applicable to [Company Name]’s place of incorporation, without regard to conflict-of-law rules. The parties will attempt to resolve any dispute informally before pursuing formal proceedings.

13. Severability and Assignment

If any provision of these Terms is found unenforceable, the remaining provisions remain in full effect. Our failure to enforce a provision is not a waiver of it. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets.
